Lawful bases for using your information
Under UK GDPR, I must have a lawful basis for using your personal information.
Depending on the situation, I may rely on one or more of the following lawful bases:
Contract — where I need to use your information to provide services you have requested, such as responding to an enquiry, arranging sessions or delivering therapy.
Legitimate interests — where I have a legitimate business or professional reason to use your information, and this does not override your rights and freedoms. This may include responding to enquiries, managing client communication, maintaining business records, improving my website, or protecting my practice.
Consent — where you have actively chosen to receive marketing emails or where consent is otherwise required.
Legal obligation — where I need to use or keep information to comply with the law, such as tax, accounting, safeguarding, regulatory or legal requirements.
Vital interests — in rare circumstances, where information may need to be used or shared to protect someone’s life or safety.
Where I process special category data, such as health or therapy-related information, I will also rely on an additional condition under UK GDPR. This may include where processing is necessary for the provision of health or social care, where it is necessary for legal claims, where there is a substantial public interest such as safeguarding, or where you have given explicit consent for a specific purpose.
Therapy notes and sensitive information
If you become a therapy client, I will keep appropriate therapy records. These may include assessment information, session notes, correspondence, risk information, treatment plans, review notes and administrative records.
Therapy records are kept securely and are only used for purposes connected with providing therapy, maintaining safe and ethical practice, meeting professional obligations, supervision where appropriate, legal or insurance requirements, and safeguarding where necessary.
I do not sell, rent or trade your personal information.
Sharing your information
I only share personal information where there is a clear reason to do so.
This may include sharing information with trusted third-party service providers who help me run my practice, such as website hosting, email, secure forms, booking systems, video call platforms, payment processors, accounting systems, email marketing systems, or practice administration tools.
These providers are only given the information needed to provide their service and are expected to keep your information secure.
In some circumstances, I may need to share information without your consent, for example:
if there is a serious risk of harm to you or another person
if there is a safeguarding concern involving a child or vulnerable adult
if I am required to do so by law or court order
if disclosure is necessary for legal, regulatory, professional or insurance purposes
if there is a concern relating to terrorism, money laundering or another serious legal matter
Where possible and appropriate, I will discuss this with you first, but this may not always be possible.
Supervision and professional support
As part of ethical therapy practice, I may discuss aspects of client work in professional supervision. Where this happens, I aim to protect your identity as far as possible. Supervisors are also bound by confidentiality and professional standards.
Email and online communication
Email and online communication are convenient but cannot be guaranteed to be completely secure. Please consider this when choosing what information to include in emails, contact forms or messages.
If you contact me through social media, please avoid sharing sensitive personal or clinical information. Social media is not a secure or appropriate place to discuss therapy-related information or data protection concerns. I may ask you to contact me by email instead.
Marketing emails
If you sign up to receive emails from Eatology, I will use your email address to send you relevant updates, resources, information or offers.
You can unsubscribe from marketing emails at any time by clicking the unsubscribe link at the bottom of the email or by contacting me directly.
Unsubscribing from marketing emails does not stop necessary service-related emails if you are a current client or have purchased a service.
Cookies and website analytics
The Eatology website may use cookies or similar technologies to help the website work properly, understand how visitors use the site, improve the website and, where relevant, support marketing activity.
Some cookies are essential for the website to function. Others may be used for analytics or marketing purposes.
Where cookies or tracking technologies are used for advertising, profiling, retargeting or similar marketing purposes, these should only be used where you have given consent.
You can usually change your cookie preferences through the cookie banner or settings on the website, and you can also manage cookies through your browser settings.
Third-party links
This website may include links to other websites or platforms. I am not responsible for the privacy practices of external websites. You should read the privacy policy of any external website you visit.
How long I keep your information
I only keep personal information for as long as necessary for the purpose it was collected, including legal, professional, insurance, accounting and safeguarding requirements.
As a general guide:
enquiry information may be kept for a limited period after the enquiry has been dealt with
mailing list information is kept until you unsubscribe or ask for it to be removed
financial records are usually kept for accounting and tax purposes for the required legal period
therapy records are kept for a period in line with professional, legal and insurance requirements
data protection complaint records may be kept for as long as necessary to show how the complaint was handled and to meet legal or regulatory requirements
When information is no longer needed, it will be securely deleted or destroyed.
Your rights
Under UK data protection law, you have rights over your personal information. These may include the right to:
be informed about how your information is used
access a copy of your personal information
ask for inaccurate information to be corrected
ask for information to be deleted in certain circumstances
ask for the use of your information to be restricted
object to certain uses of your information
withdraw consent where consent is the lawful basis being relied on
ask for certain information to be transferred to another provider where applicable
These rights are not absolute and may depend on the circumstances. For example, I may need to keep some information to meet legal, professional, safeguarding, insurance or accounting obligations.
To make a request about your personal information, please contact me at claire@eatology.co.uk.
I may need to confirm your identity before responding to a request.
Data protection complaints
If you are concerned about how I collect, use, store or protect your personal information, you can raise a data protection complaint with me directly.
Please email claire@eatology.co.uk with the subject line Data protection complaint.
To help me look into your concern, please include:
your name
the email address you used to contact me
a brief description of your concern
what you would like me to look into
any relevant dates or supporting information
I will acknowledge your complaint within 30 days of receiving it. I will then make appropriate enquiries, keep you updated where needed, and explain the outcome to you without undue delay.
If I need to confirm your identity, or if someone is complaining on your behalf, I may ask for appropriate proof of identity or authority before sharing information or investigating further.
You also have the right to complain to the Information Commissioner’s Office, the UK regulator for data protection matters.
